Please take a moment to read through Terms and Conditions. The below Rental Term along with the Contract Terms and Conditions constitute the whole agreement between Client and New Kendall Party Rental.
1. CONDITIONS OF USE: By accepting delivery of rental, customer agrees to all terms and conditions shown on this rental contract. Customer assumes full responsibility for all rentals, including their safe and proper use, operation, maintenance, and return to New Kendall Party Rental. Renter is responsible for all loss, damage, or repair. New Kendall Party Rental makes no warranties of merchantability or fitness for particular purpose, or any warranties, expressed or implied. General wear is referred to as one single rental's normal deterioration under reasonable use.
2. ORDERS REVIEW: It is the Client's responsibility to review and confirm all the details of the quote/invoice at all times, including date and time of the event, address, quantities, colors and sizes. If at the moment of delivery Client claims a difference than what has been stated in the quote/invoice, New Kendall Party Rental reserves the right to make the adjustments and will make a decision based on availability, it will be the Client's responsibility to cover any extra fees incurred in these changes.
3. DELIVERY: Delivery Fee only includes dropping off the items and picking them up. Client shall PREPARE ALL ITEMS FOR PICK-UPS IN THE SAME WAY THEY WERE DELIVERED. If the Set-up Fee was not paid, all tables and chairs must be knocked down and stacked ready for pick up, Chiavari chairs cushions must be untied from the chairs and put back in cushion bags, chairs must have their cover and stacked just as they were delivered. In any event rinse dinnerware, flatware, glasses, etc. free of food and packed in their containers. Linen(s) should be refuse free and dried to prevent staining and mold/mildew. Linen(s) should be free of wax. An additional charge will apply if the above items do not meet the above conditions. Acceptance of equipment constitutes acceptance of terms of contract. New Kendall Party Rental will inform the client via E-mail, Text or Phone Call the time of Delivery and Pick-Up and it is the Client's responsibility to make sure the area and/or the items are ready on time for delivery/pick-up. Additional fees may be charged if the delivery or pick-up are delayed or rescheduled.
4. DAMAGE WAIVER: The Damage Waiver fee of 5% of the sub-total order is an optional fee added at time of contract. Damage waiver will cover incidental damages up to 25% of the sub-total amount. Linens must be returned on time in order to avoid additional stain or mold damage resulting in additional or irreversible repair. All damages resulting out of carelessness, made purposely or through acts of God will not be covered. Some items are not eligible for Damage Waiver (dance floor, tent, liner, backdrop, special tables) . Damage Waiver is paid up-front and non-refundable. The items will remain at all times in the location where it was delivered and will all be returned at once to the New Kendall Party Rental. Charges will be paid prior to delivery and any extra charges for damaged/lost items will be paid at the time the items are returned to the rental agent. In the event the renter fails to return said items at the agreed time, or fails to abide by any of the other terms of this contract New Kendall Party Rental. may repossess the items without notice to the renter, and the rental agent is released from all claims there from. All charges are based on the time items are in renter's possession whether in use or not.
5. RETURNS: If Renter fails to return all returned items upon agreed time, Renter agrees to pay for all additional charges. If Renter refuses to return rented items, the Renter agrees that New Kendall Party Rental may take all reasonable actions necessary to recover rented items without prior notice or legal process. All items are due back to New Kendall Party Rental warehouse on the return date listed on your agreement. After two (02) days late items are subject to a 10% late fee, after three (03) days late items are subject to 25% late fee. Items unreturned after ten (10) days will be considered lost and be billed the replacement value of the item.
6. PAYMENT: All invoices are due in full prior to delivery unless prior arrangements have been made and accepted by New Kendall Party Rental. A non refundable deposit of at least 50% of the total amount of the agreed upon invoice shall be paid by Renter at time of booking in order to reserve the date and merchandise. The remainder of the balance shall be paid by Renter 5 days prior to the set event date. If this is not completed, New Kendall Party Rental retains the right to withhold any rentals from said customer until balance is paid in full. A late fee of 20% will be added on all past due invoices. A returned check fee of $35 will be assessed on all NSF or returned checks.
7. PICKUP AT OUR WAREHOUSE: A credit card authorization form, a copy of your driver's license and your credit card will be requested at the time of pickup. Pick-up orders are self-service, if you need assistance, please bring someone to help you load, the New Kendall Party Rental team will deliver the order to the pickup area and is not authorized to load the items into the car.
8. Our CANCELLATION POLICY is as follows: If canceled by:
Ten (10) Business days or more before delivery date: 50% Future Order Credit
Nine (09) to Four (04) Business days before delivery date: 25% Future Order Credit
Three (03) to Delivery date: No Refund
DEPOSIT AND HOLIDAYS DATE ORDER: No Credit
